DareFly Terms of Service
Effective
These terms are a contract between you and DareFly Inc. ("DareFly", "we") for the DareFly app and darefly.app. Please read them; we kept them short.
1. Who can use DareFly
You must be at least 18 and able to enter a contract. One account per person.
2. Your account
Keep your password private and tell support@darefly.app if you think someone else has it. You are responsible for what happens under your account until you do. We may suspend or close accounts that break these terms.
3. What DareFly is, and isn't
DareFly learns your taste from the cards you swipe and builds trip ideas and plans around it. Plans, entry-rule summaries, passport warnings and everything else in the app are suggestions to help you decide. They are not travel, legal, immigration, health or safety advice. Before you travel, confirm visas, entry rules, health requirements, prices, opening hours and safety with the official government and provider sources. DareFly is not a travel agent, does not sell bookings, and is not a party to anything you book elsewhere.
4. Bookings with other companies
When you tap Book you leave DareFly for a partner's site (for example Booking.com, GetYourGuide or Skyscanner). Your booking is with them under their terms. We may receive a referral fee if you book; it never changes your price. We are not responsible for their services, prices, cancellations or data practices.
5. Credits and referrals
Credits are earned inside DareFly and spent inside DareFly. They have no cash value, cannot be bought, sold, transferred or redeemed for money, and are not property. We may change how credits are earned or spent, or end the programme, with notice in the app; credits already in your balance stay usable for at least 30 days after such a notice. Referral and verification rewards pay once per person and once per phone number. Creating multiple accounts, using fake identities, bots or scripts, or otherwise gaming credits or referrals is a breach of these terms; we may remove the credits and close the accounts involved.
6. Acceptable use
Don't: break the law; use the app on someone else's behalf without permission; scrape, copy or mirror our content or the app; reverse-engineer it; interfere with our systems or other users; use automated tools to swipe or build plans; upload or report content you know is false. We may remove content and suspend accounts to enforce this.
7. Your data and your content
Our Privacy Policy (darefly.app/privacy) explains what we collect and how we use it. You give us permission to use what you enter in the app (swipes, preferences, trip details, reports) to run DareFly for you and to improve it, including in aggregated, non-identifying form. You keep any rights you have in it.
8. Our content
The app, its design, text, graphics, photos, the DareFly name, wordmark and star, and the plans we generate for you are ours or our licensors'. We give you a personal, non-transferable licence to use the app and your plans for your own travel. Everything else is reserved.
9. Ending things
You can delete your account any time from Profile or at darefly.app/delete-account; deletion completes after a 30-day grace period, during which signing in keeps the account. We may suspend or close your account if you breach these terms, if the law requires it, or if we stop offering DareFly, with notice where practical. Sections 7 to 15 survive closure.
10. Changes to DareFly and to these terms
DareFly will change, and features may be added or removed. We may update these terms; the effective date at the top tells you when. For changes that reduce your rights we will give at least 30 days' notice in the app. Using DareFly after a change takes effect means the new terms apply.
11. No warranties
DareFly is provided "as is" and "as available". To the fullest extent the law allows, we make no promises that it will be uninterrupted, error-free, or that any plan, price, entry rule or warning is accurate, complete or current.
12. Limitation of liability
To the fullest extent the law allows, DareFly and its officers, employees and partners are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, missed flights, cancelled trips or travel costs, arising from your use of DareFly or anything you book elsewhere. Our total liability for any claim is limited to US$100. Nothing in these terms limits liability that cannot be limited by law, including for fraud, gross negligence or wilful misconduct.
13. Disputes
Talk first. Email support@darefly.app describing the problem; we will try to resolve it within 30 days.
Arbitration. If we can't, you and DareFly agree to resolve any dispute by binding individual arbitration under the American Arbitration Association's Consumer Arbitration Rules, by video, phone or documents unless you choose an in-person hearing near where you live. Either side may instead bring an individual claim in small-claims court. You and DareFly waive the right to a jury trial and to bring or join a class, collective or representative action. If this class waiver is found unenforceable for a claim, that claim goes to court, not arbitration.
Opt out. You can opt out of arbitration by emailing privacy@darefly.app with "arbitration opt-out", your account email and your name within 30 days of first accepting these terms. Opting out does not affect anything else in these terms.
Consumers protected by local law. If you live in the European Union, the United Kingdom, Quebec, Australia, or anywhere else whose consumer laws give you the right to bring claims in your local courts or under your local law, nothing in this section takes that right away, and those laws apply to you where they are mandatory.
14. Indemnity
If someone brings a claim against DareFly because you broke these terms or the law while using DareFly, you will cover our reasonable costs and losses from it.
15. Governing law
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, except where mandatory consumer law in your country of residence applies instead. Subject to section 13, courts in Delaware have jurisdiction.
16. General
If part of these terms is unenforceable, the rest still applies. Our not enforcing a term is not a waiver. You may not transfer these terms; we may transfer them as part of a merger, sale or reorganisation, with notice. These terms and the Privacy Policy are the entire agreement between us about DareFly.
17. App stores
If you downloaded DareFly from Apple's App Store, these terms are between you and DareFly, not Apple. Apple has no obligation to provide maintenance or support, is not responsible for any claim relating to the app or your use of it (including product liability, legal or regulatory compliance and intellectual-property claims), and is a third-party beneficiary of these terms with the right to enforce them against you. Google Play's terms apply in the same way to downloads from Google Play. You confirm you are not in a country under a US government embargo and not on any US government list of prohibited parties.
